For MessengerPeople GmbH (‘MessengerPeople’), data privacy is paramount. We aim to store information only if and for as long as absolutely necessary. We use up-to-date encryption procedures and take all technical and organisational measures necessary to prevent the unauthorised access or misuse of data. Data are processed and protected in accordance with applicable statutory provisions and the General Data Protection Regulation (EU) 2016/679 («GDPR»).

1. General information

The Notify app (‘Notify’) was developed to leave behind as little metadata as possible on a central server. Users are identified through a unique, random ID. For interactions with WhatsApp, the device’s telephone number is connected to the unique ID from the app.

You attest in accordance with Art. 8 GDPR that you are at least 16 years old or have the consent of your parent or legal guardian. By using the app, you agree that data will be collected, processed and used as described in the following.

2. Purpose of data processing

Notify processes data to allow brief messages and media to be transmitted from companies to participants and vice versa. Data are processed within Notify exclusively in member states of the European Union or other contracting states to the EEA Agreement. If desired, WhatsApp will be called up with pre-defined messages.

3. Scope and duration of data processing

A. Inventory data

The following inventory data will be collected or stored in connection with the use of Notify:

• Notify ID
• Cell phone number
• Device name, device language
• Operating system with version, and version of the Notify app
• Date of creation for the Notify ID
• Date of the last login
• Device token for push services

The following data are optional and can be disclosed by the user in addition if desired to facilitate tracking and detectability

• Nickname

Communication will occur only with the registered company. No data will be forwarded to other participants.

B. Message contents

Notify encrypts all messages during transport. This encryption prevents unauthorised third parties from reading the data you transmit.

C. Address book data

The address book will not be accessed.

4. Data processed by third parties

MessengerPeople passes the data on to companies to which participants subscribe. WhatsApp can be used to communicate with the companies, depending on the settings.

To improve the app, Google Analytics evaluates usage behaviour for Firebase. Users can deactivate that evaluation in the app settings.

Some companies offer a chat function only through WhatsApp. Those companies are identified accordingly. Communication with WhatsApp is always initiated by the participant – never automatically through the app.

5. Rights to information, rectification, blocking, erasure and objection

You may at any time obtain information on the data concerning you that are stored by MessengerPeople GmbH. You may also have your personal data corrected, blocked, or erased (unless they cannot be erased because they must be stored by law to process business transactions).

The stored inventory data depend on the subscribed companies. By sending the chat ‘Profile’, the participant will be sent a link through which he or she can view the data.

If the message ‘Erase all data’ is sent to a company with which a subscription exists, all personal data connected to that company will be irrevocably erased.

7. Modifying the data privacy provisions
